Wind-up Privacy Policy For Websites With Minors

The privacy and security of the users of this site (the "site") is very important to us. This site is made available by Wind-Up Entertainment, Inc. ("Wind-Up," or "we," "us," or "our"). This privacy policy (the "Policy") governs our use of information collected online at this site only and does not apply to any information we may collect offline.

This Policy informs you of how we use and protect your personal information and about what choices you may have concerning our use of such information at this site. Please read this Policy carefully. We reserve the right to change this Policy from time to time in order to address new issues and reflect changes on the site. We will post any changes on this page so that you will always know what information we gather, how we might use that information, and whether we will disclose that information to anyone. Under certain circumstances (e.g., with respect to material changes), we may also elect to notify you of changes or updates to our Policy by additional means, such as posting a notice on the front page of the site or sending you an e-mail. If we make any material changes to our privacy collection practices with respect to children under 13 from whom we have collected personally identifiable information, we will obtain any new parental consents that may be required. Please refer back to this Policy regularly.

Note to Parents: We urge all parents to participate in their children's exploration of the Internet and any online services, and to teach their children about protecting their personal information while online. If you have any concerns about this site, you can find our contact information at the end of this policy.

Personally-Identifiable Information
At this site, we will only collect personally identifiable information that you voluntarily submit to us in connection with your use of the site. Such "personally identifiable information" may include, for example, email addresses and first names. Except as described in this Policy, we will never intentionally disclose any personally identifiable information about you as an individual user to any third party without having received your permission.

For our users under 13, we also collect their parents’ email address, so that we can notify the parents of their child’s registration for our e-news lists, and give the parents the ability to opt-out on behalf of their child.

We are prohibited from conditioning a child’s participation in an activity on the site on the child’s disclosing more personal information than is reasonably necessary to participate in that activity.

For our users under 13, we will only use their personally identifiable information for the purpose of responding to their request to receive our e-news letter(s).

For our other users, if you do provide us with personally identifiable information, we may use it to conduct the activities described above, to respond to your questions or comments, to contact you to confirm your registration, to contact you about your account, or to contact you regarding certain changes to this site’s Terms and Conditions and this Policy. Also, if you give us permission, we may also use personally identifiable information for internal or external marketing and promotional purposes. On occasion, for example, we may send you e-mails to introduce a product or service that we think might be of interest to you. For us to obtain your permission to send you this information, we will give you an opportunity to "opt-in" when you provide your personal information. If you do "opt-in," you may choose to "opt-out" at any time, even after you have provided personal information, by following the procedures set forth below at the end of this Policy. Please note, however, that under certain circumstances, if you initially do not choose to "opt-in," the change may not be retroactive, or if you later "opt-out," you may not be eligible for certain benefits for certain personally identifiable information is needed.

We may use service providers to help us operate our business and the site or administer activities on our behalf. We may share your information with these third parties, which will use such information on our behalf for those limited purposes.

We may also use the email addresses collected to the extent reasonably necessary to protect our security and integrity, to respond to judicial process, to protect against liability and, to the extent permitted under other provisions of law, to provide information to law enforcement agencies or for an investigation on a matter related to public safety.

In the event that Wind-Up, or a significant portion of its assets, is acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation (each a "Business Transfer"), information we collect on the site may be one of the transferred assets. If, as a result of such a Business Transfer, we make any material changes to our privacy collection practices with respect to children under 13 from whom we have collected personally identifiable information, we will obtain any new parental consents that may be required.

Non-Personally Identifiable Information
We may collect non-personally identifiable information through tracking technologies such as "cookie" technology and IP address tracking. Cookies are small data files that are sent to a user’s browser or related software from a Web server and stored on a computer’s hard drive. Cookies track where a user travels and what a user looks at on a web site. Most browsers are set to accept cookies. You can set your browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of this site may not function properly. The types of non-personally identifiable information collected through such tracking technologies might include the browser you use, the type of computer, the operating systems, the Internet service providers, and other similar information. Our system also automatically gathers information about the areas you visit on our site and about the links you may select from within our site to other areas of the World Wide Web or elsewhere online.

We also may use "Web beacons" (aka "clear GIFs" or "pixel tags") or similar technologies in the site and/or in our communications with you to enable us to know whether you have visited a Web page or received a message. A clear GIF is typically a small or transparent image located on a Web page or in an e-mail or other type of message, which helps to verify an individual’s viewing or receipt of a Web page or message, and may enable us to relate such viewing or receipt to other information, including personally identifiable information (except, however, with respect to users of this site under 13).

We use this information for internal system administration, to help diagnose problems with our servers, and to administer the site. We also may use such information in the aggregate to understand how our users as a group use the services and resources provided on our site. This way we know which areas of our site are favorites of our users, which areas need improvement, and what technologies are being used so that we may continually improve our site. Except for our users under 13, we also may link such non-personally identifiable information with personally identifiable information, and we may share aggregate statistical information with our partners, suppliers and other third parties, but we will not share any individual names, personal navigational or other personally identifiable information (except as otherwise provided in this Policy), unless we have your permission. We may also collect demographic information that you provide to us, such as your age. Except with respect to our users under 13, we may use such information tailor the site and the site’s services to your interests. We may share such demographic information on an aggregate non-identifiable basis with third parties.

Although we do not at the present time, we may, at some time in the future, have advertisers with display ads on our site that solicit or contain technology (such as cookies) to collect information about our users for the advertisers. Similarly, some advertisements that may appear on the site may be provided by third parties who will be helping to manage them for us. Those third parties also may employ cookies and other tracking technologies to recognize your computer each time they send you an online advertisement, and to measure advertising effectiveness. We do not control these companies’ use of cookies and other tracking technologies. Some of these companies (like the ad networks) are members of the industry group, the Network Advertising Initiative, which offers a single location to opt out of their cookies. For more information, we encourage you to visit the Network Advertising Initiative’s consumer web site, at http://www.networkadvertising.org/consumer.

Links To Other Sites
Users may find advertising or other content on the site that links to other sites and services, including other sites and services operated by Wind-Up or subsidiaries or affiliates of Wind-Up, as well as sites and services of our partners, suppliers, advertisers, sponsors, licensors, and other third parties (collectively, "Linked Sites"). We accept no responsibility for the content, information or links that may appear on Linked Sites, nor do we accept responsibility for the privacy practices on Linked Sites. In addition, Linked Sites, including their contents and links, may be constantly changing. Linked Sites may have their own privacy policies and customer service policies, or no policy (or policies) at all, and your use of such Linked Sites will be subject to any such policies. We encourage you to review the privacy policies of any Linked Site you visit before providing any of them with your personally identifiable information.

Security
Although we take careful measures to secure both your personally identifiable information and our physical premises, "perfect security" does not exist on the Internet and our efforts in this regard must necessarily be limited by what is practical in light of our equipment and technology.

In the unlikely event that we believe that the security of your personally identifiable information in our possession or control may have been compromised, we may seek to notify you of that development. If a notification is appropriate, we would endeavor to do so as promptly as possible under the circumstances, and, to the extent we have your e-mail address, we may notify you by e-mail. Unless you notify us and provide us with alternative contact information (which you are free to do at any time by emailing us at privacy@wind-upent.com), you consent to our use of e-mail as the means of such notification.

Access To/Correction of Information
Parental Right To Review/Delete Information

If you would like to review or edit any personal information we have retained about you in our database, send an email to privacy@wind-upent.com.

Parents of a child under 13 have the right to review the personally identifiable information we have collected from their child online, and/or to request that we delete such information. Parents may use the contact information at the end of this policy to contact us so that you can exercise these rights.

Choice/Opt-Out
If you "opt-in" to receive information from Wind-up, you can change your mind later. If at any time you would like to stop receiving such information, you can let us know by sending an e-mail stating your preference to privacy@wind-upent.com. Additionally, each promotional e-news letter you may receive from us will enable you to opt-out of receiving all future promotional emails from us.

Your Acceptance of These Terms
By using this site, you signify your acceptance of this Policy. If you do not agree to this Policy, please do not use this site. Except as stated above with respect to children under 13, your continued use of this site following the posting of changes to this Policy will be deemed your acceptance of those changes.
